• "Digital Product": Any product delivered electronically, including but not limited to licenses, keys, and digital downloads.
• "Activation": The process of verifying and enabling your license key for use.

3. Digital Product Policy

All products offered by TheLicenseHost.com are digital products delivered electronically. You acknowledge and agree that:

• Delivery occurs automatically upon successful payment verification.
• You are responsible for providing accurate and valid IP addresses and server information for license activation.
• It is your responsibility to ensure compatibility of the license with your server environment and operating system.
• We reserve the right to modify, update, or discontinue any digital product at any time without prior notice.

4. Refund Policy – IMPORTANT

4.1 General Non-Refundable Policy

License Activated = Generally Non-Refundable. Once a software license has been activated, provisioned, or assigned to the server IP provided by the customer, the order is considered fulfilled. Because software licenses are digital products delivered electronically, activated licenses are generally non-refundable and non-exchangeable, except as required by applicable law or as explicitly stated in writing by TheLicenseHost.

4.2 Exceptions for Unactivated Licenses

Refund requests for unactivated licenses may be considered within 48 hours of purchase, subject to our sole discretion. To request a refund for an unactivated license, please contact our support team via ticket or email with your order details.

4.3 Refund Process

All refund requests must be submitted through our official support channels. We reserve the right to verify the license status (activated/unactivated) before processing any refund request.

5. PayPal & Stripe Dispute/Chargeback Policy

We take disputes and chargebacks very seriously. By purchasing from TheLicenseHost.com, you agree to contact us first before filing a dispute or chargeback with PayPal, Stripe, or your credit card issuer. Unauthorized disputes or chargebacks may result in immediate suspension or termination of all your active licenses and services, and may ban you from future purchases.

• We will respond to all support tickets and concerns within a reasonable timeframe.
• Filing a dispute or chargeback without first contacting us will be considered a violation of these Terms.

6. VPS & Dedicated Server Terms (if applicable)

6.1 Service Uptime

We strive to provide excellent uptime for our VPS and dedicated server services. However, we do not guarantee 100% uptime and are not liable for temporary downtime due to maintenance, network issues, or circumstances beyond our control.

6.2 Acceptable Use Policy

You agree not to use our VPS/dedicated server services for any illegal or unauthorized purpose, including but not limited to:

• Spamming or sending unsolicited email
• Hosting malicious content, malware, or phishing sites
• Violating copyright or intellectual property laws
• Engaging in hacking, port scanning, or other unauthorized access activities

We reserve the right to suspend or terminate any service found violating our acceptable use policy without prior notice and without refund.

6.3 Server Management

Unless explicitly stated as a "managed" service, you are solely responsible for the management, security, and maintenance of your VPS or dedicated server, including operating system updates, software configuration, and data backup.

7. License Usage Rules

• You may only use the license on the number of servers/accounts specified in your order.
• You may not resell, sublicense, or transfer your license to any third party without our explicit written consent.
• You may not reverse engineer, decompile, or attempt to bypass or crack the license activation mechanism.
• We reserve the right to suspend or terminate any license found violating these usage rules, without prior notice and without refund.

8. Intellectual Property

All software, trademarks, logos, and content provided through our Services remain the property of their respective owners (cPanel, Plesk, WHMCS Ltd., etc.). Your use of these software products is subject to their respective end-user license agreements (EULAs), which you agree to abide by.

9. Limitation of Liability

To the fullest extent permitted by law:

• TheLicenseHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services.
• Our total aggregate liability for any claim arising under these Terms shall not exceed the amount actually paid by you for the specific Service giving rise to the claim.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which TheLicenseHost operates. Any dispute shall be resolved in the courts of that jurisdiction.

11. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting to our website. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.
